Following our latest monthly legal update sent earlier this week, please be informed that new relevant legislation has been enacted on 6 March 2017* in the Republic of Angola, which may require immediate attention.

Employment Contracts – New Legal Templates
Presidential Decree 40/17, of 6 March 2017
Summary: This new act of legislation entered into effect on the date of publication by the Official Gazette, and enacts the following two draft employment contracts:i) Permanent employment contract; and

ii) Fixed-term employment contract.

These draft employment contracts are in line with the main principles of the General Labour Law and constitute mere guidelines and thus, are not mandatory.

The use of these guidelines must be carefully assessed and considered as they do not reflect several specific and concrete features of employment contracts.

All legislation contrary to this new diploma is revoked, namely the Executive Decree 80/01 of 28 December 2001.

Expatriate Employees – Amendments to Legal Framework
Presidential Decree 43/17, of 6 March 2017
Summary: This new act of legislation entered into effect on the date of publication by the Official Gazette, and revokes Decree 5/95, of 7 April 1995 and Decree 6/01, of 19 January 2001. However, the new diploma explicitly sets forth the 70 / 30 rule, with some adjustments.In respect of the legal framework applicable to expatriate employees, this new diploma introduces the following main amendments:

i) All expatriate employees must be paid in Kwanzas;

ii) New and specific penalties and fines for material breach have been enacted;

iii) The Central Bank will determine the amounts paid in Kwanzas to the expatriate employees that may be transferred abroad.
